Terms of Service

1. Operator and scope

Bidque is operated by Aleksei Goncharov, an individual based in San Diego, California, United States. Contact: support@bidque.com. These Terms cover the Bidque website, broker dashboard and desktop and mobile applications. By using the service, you agree to these Terms. If you act for an organization, you must have authority to do so.

2. Eligibility and assigned access

You must be at least 18 and legally able to enter into these Terms. Customers sign in using an access code issued by a participating broker. Available accounts, features, permissions and access duration depend on that broker and the relevant auction provider. Keep your access code confidential and report suspected unauthorized use promptly.

Brokers must be authorized to connect their auction accounts and grant the access they assign. Customers may use only their assigned access. Using Bidque does not expand the rights granted by an auction provider or override its rules.

3. Auction services and third-party content

Bidque provides software for managing assigned auction access and viewing related activity. It is not an auction operator, vehicle seller or escrow service. Copart, IAA and other provider names, vehicle listings, photographs and trademarks belong to their respective owners. Bidque is independent and is not endorsed by or affiliated with those providers.

Auction websites, accounts and transactions are subject to the provider’s own terms and privacy policies. You must comply with applicable access restrictions and obtain any permissions needed for your use. A statement of non-affiliation is not a grant of permission to use third-party content.

4. Bids, offers and vehicle purchases

Actions you initiate through an auction website may create binding obligations under that provider’s terms. Check the account, vehicle, amount, currency and fees before submitting an action. Confirm acceptance and final status directly with the auction provider; a Bidque activity record is not independent proof of acceptance, payment or ownership.

Network delays, provider changes or interruptions can affect displayed information and delivery of actions. Do not repeat a bid or offer solely because the app has not yet displayed an update. Vehicle condition, title, transport, taxes and auction fees must be checked with the responsible seller, broker or provider. Bidque does not guarantee a vehicle’s condition or the completeness or timeliness of third-party data.

5. Service fees

Any paid Bidque service is subject to the price, billing period, renewal terms and cancellation or refund conditions disclosed when that service is ordered. These Terms alone do not authorize a charge or enroll you in a subscription. Contact support@bidque.com about Bidque billing or cancellation. Mandatory statutory refund and consumer rights remain unaffected.

Fees charged by your broker or auction provider are separate from Bidque service fees and are governed by your arrangement with that party. Ending Bidque access does not cancel an accepted auction bid or outstanding payment obligation.

6. Acceptable use

Do not access accounts or personal information without authorization, share access beyond your permissions, evade security or customer-access controls, interfere with the service, submit malicious files, impersonate another person, or use Bidque for fraud or unlawful bidding. Do not reproduce third-party material without the rights required for that use.

7. Software and submitted material

Subject to these Terms, you may use Bidque for its intended functions. Bidque software and original materials remain the property of their respective owners. You retain rights in information you submit and authorize its processing and display as needed to provide the service and support. This does not give us ownership of your records. Applicable open-source licenses and mandatory rights are preserved.

For an app obtained from Apple, the applicable Apple Standard Licensed Application End User License Agreement governs the app license unless a separate valid license is supplied. These Terms govern the associated Bidque service and do not displace mandatory store terms.

8. Privacy and support

Our Privacy Policy explains account, device, session, auction-activity and support-data processing, including broker access and third-party auction websites. Send support and privacy requests to support@bidque.com. Do not include access codes, auction passwords or payment-card details in support messages.

9. Availability and termination

We may maintain, change or discontinue features, and third-party changes may interrupt compatibility. We do not guarantee uninterrupted availability. You may stop using Bidque at any time. Your broker may revoke assigned access. We may restrict access for security, material misuse, non-payment of agreed fees or legal requirements, with notice where practicable and required.

Termination does not erase outstanding obligations or automatically delete server records. Requests for access, correction or deletion are handled under the Privacy Policy and applicable law.

10. Responsibility and applicable law

To the extent permitted by law, the service is provided as available without a guarantee that it will be free of errors or meet every purpose. Nothing in these Terms excludes liability or rights that cannot lawfully be excluded, including mandatory consumer protections. Each party remains responsible for its own acts and legal obligations.

California law governs these Terms except where mandatory law provides otherwise. This choice does not deprive consumers of protections or access to courts that applicable law grants them. Contact support@bidque.com first to help resolve a concern; doing so does not limit any statutory remedy.

11. Updates and contact

We may revise these Terms as the service changes. The current revision date is shown above. We will provide notice of material changes and obtain agreement where required by law; changes do not retroactively alter completed transactions.
